5. Product Compliance and Certification

Product safety, testing, labeling, certification, packaging, battery, textile, electrical, radio-frequency, transportation, environmental, and import requirements may differ by product, application, destination market, customer role, and final product configuration. Unless expressly confirmed in a written document issued for a specific product and configuration, website content does not represent or warrant that a product:

  • has received a particular certification or regulatory approval;
  • complies with every law or standard in every market;
  • is approved as personal protective equipment;

Heated, powered, illuminated, fan-equipped, battery-operated, solar-powered, pet-related, and wearable products may require application-specific safety evaluation. Unless expressly identified and documented for that purpose, MotionWarm products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Website content is not a substitute for product testing, workplace safety evaluation, professional advice, regulatory review, or instructions supplied with a specific finished product.

7. Intellectual Property

The website and its contents may include:

  • text and product descriptions;
  • photographs and videos;

To the fullest extent permitted by applicable law, MotionWarm’s total aggregate liability arising solely from your access to or use of this website will not exceed one hundred United States dollars (US$100). This website limitation does not replace or modify liability provisions contained in a separate written quotation, purchase order, supply agreement, manufacturing agreement, or other commercial contract. Some jurisdictions do not permit certain exclusions or limitations. In such cases, these limitations apply only to the maximum extent permitted by applicable law.

13. Indemnification

If any provision of these Terms is found unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.

18.3 No Waiver

A failure or delay in enforcing a provision of these Terms does not waive the right to enforce that provision later.

18.4 Assignment
